Panorámica general del sistema penitenciario español

Abstract

El artículo realiza una visión general del sistema penitenciario español desde una perspectiva fundamentalmente empírica. Tras destacar la importancia de tener una visión más allá de lo jurídico y presentar las principales fuentes estadísticas, se presentan datos sobre la población reclusa y su evolución, los delitos más representados, la duración de las penas y el perfil de los internos, en cuanto a su edad, sexo, nacionalidad o situación legal. Además, se harán referencias a las diferencias entre las tres administraciones penitenciarias del estado español, así como con los países de nuestro entorno. Por otro lado, se analizan de manera específica la clasificación y el régimen penitenciario, el tratamiento penitenciario y la resocialización, la atención sanitaria y las situaciones abuso y malos tratos.

The article provides an overview of the Spanish prison system from a fundamentally empirical perspective. After highlighting the importance of having a vision beyond the legal aspect and presenting the main statistical sources, data is presented on the prison population and its evolution, the most common crimes, the length of sentences and the profile of the inmates, in terms of age, sex, nationality and legal status. In addition, references will be made to the differences between the three penitentiary administrations of the Spanish state, as well as with the countries of our environment. On the other hand, classification and the penitentiary regime, penitentiary treatment and re-socialisation, health care and situations of abuse and ill-treatment are specifically analysed.
