La orden europea de protección y su incidencia estadística en la justicia penal española para garantizar una tutela más eficaz a las víctimas de la violencia de género

Abstract

Con el presente trabajo pretendemos analizar la incidencia estadística de la orden europea de protección en nuestro sistema de justicia penal para garantizar una tutela más eficaz a las víctimas de la violencia de género. Y valorar en qué medida este nuevo instrumento de reconocimiento mutuo, mediante el cual se pretende hacer efectiva que la protección decretada a favor de una víctima durante un procedimiento penal nacional pueda extenderse a otro Estado miembro cuando se desplace o resida en ese Estado, se ha aplicado en la práctica por los órganos judiciales de nuestro país, y en particular por los Juzgados de Violencia sobre la Mujer durante los años 2015 a 2020. Para a partir de este análisis, examinar las posibles causas que hayan podido facilitar u obstaculizar la efectividad de este instrumento de cooperación judicial en la realidad española, tras la implementación de las disposiciones de la Directiva 2011/99/UE a nuestro ordenamiento en 2014.With the present work we intend to analyze the statistical incidence of the European protection order in our criminal justice system to guarantee a more effective protection to the victims of gender violence. And assess to what extent this new mutual recognition instrument, by means of which it is intented to make effective that the protection decreed in favor of a victim during a national criminal procedure can be extended to another member state when he moves or resides in that state, has applied in the practice of the judicial bodies of our country, and in particular by the Courts of Violence against Women during the years 2015 to 2020. Based on this analysis, examine the possible causes that may have facilitated or hindered the effectiveness of this instrument of judicial cooperation in the spanish reality, after the implementation of the provisions of Directive 2011/99/EU to our legal system in 2014.
