Abstract
La reforma que la LO 1/2015 operó sobre la libertad condicional no tuvo que haberse producido nunca, tal y como ya sospechábamos de forma anticipada antes de que el legislador tuviera a bien convertirla en una forma de suspensión de condena sinsentido. Diez años después, confirmamos que la academia estaba en lo cierto al presuponer que el cambio operado se traduciría en una herida de muerte para esta institución, que ha dejado de ser la forma preferible de extinción de las condenas pese a ser la que ofrece un mayor potencial resocializador: el licenciamiento en tercer grado –y, especialmente, en su modalidad de cumplimiento telemático– se ha convertido en la nueva predilección de los penados que aspiran a extinguir sus responsabilidades penales evitando a toda costa los peligros e incertezas del –ya no tan– nuevo régimen de libertad condicional.
The reform that Organic Law 1/2015 operated on conditional release should never have taken place, as we already suspected in advance before the legislator turned it into a form of senseless suspension of sentence. Ten years later, we confirm that the academy was right to assume that the change would result in a mortal wound for this institution, which has ceased to be the preferable form of extinguishing sentences despite being the one that offers the greatest potential for resocialization: serving sentences in third–degree –and, especially, in its telematic modality– has become the new predilection of convicts who aspire to extinguish their criminal responsibilities by avoiding at all costs the dangers and uncertainties of the –not so new anymore– parole regime.
