Abstract
El Real Decreto 893/2024 ordena, por primera vez en España, la seguridad y salud en el empleo del hogar, un sector caracterizado por una histórica y profunda desprotección. Aunque representa un avance significativo en lo simbólico, la compleja estructura jurídica de la norma reglamentaria suscita serias dudas en su proyección práctica. El artículo tiene como objetivo analizar el alcance y contenido del derecho a una protección eficaz de los empleados de hogar en su particular configuración por el Real Decreto 893/2024. A través de un examen detallado de las características principales de la norma, se exploran sus novedades más destacadas, centradas en los derechos de formación y de vigilancia de la salud, así como en la organización de la prevención. Desde un enfoque normativo estricto, se sistematizan los elementos esenciales del texto legislativo y se proporcionan criterios aplicativos e interpretativos que permitan la integración de sus aspectos más controvertidos.
Royal Decree 893/2024 establishes, for the first time in Spain, regulations on health and safety in domestic work, a sector characterized by a historically profound lack of protection. Although it represents a significant symbolic advancement, the complex legal structure of the regulatory framework raises serious doubts about its practical implementation. This article aims to analyze the scope and content of the right to effective protection for domestic workers in its particular configuration under the aforementioned decree. Through a detailed examination of the main features of the regulation, its most prominent innovations are explored, focusing on training rights, health monitoring, as well as the organization of prevention. From a strict normative approach, the essential elements of the legislative text are systematized, and application and interpretative criteria are provided to address its most controversial aspects.
