¿Es razonable que España no haya ratificado todavía la Carta Social Europea, revisada en 1996?: Algunas reflexiones sobre el estado de la cuestión

Abstract

España se declara como un Estado Social y Democrático de Derecho en el primer artículo de su Constitución, poniendo así en evidencia su carácter social-democrático. Tras haber adherido a la Carta Social Europea de 1961 en 1980 y a los protocolos de 1988 y 1991, España ha dejado de ratificar el Protocolo de 1995, sobre la reforma del sistema de control y, sobre todo, la Carta Revisada de 1996. Este trabajo procura analizar algunos de los aspectos que han contribuido a determinar este proceso de involución de la internacionalización social de España.-------------------------------------------------------------------In the first article of its Constitution, Spain declares itself as a Social and Democratic State, subject to the rule of Law, highlighting, this way, its social-democratic nature. In 1980, Spain ratified the European Social Charter of 1961 and later on the Protocols of 1988 and 1991. However, Spain failed in ratifying the Protocol of 1995 on the control system reform, and, above all, the Revised Charter of 1996. This paper tries to analyze some of the aspects that led to this process of involution into the social internationalization of Spain.
