Abstract
En las relaciones entre las empresas multinacionales y sus cadenas de valor siguen persistiendo muchos factores, legales y prácticos, que impiden determinar una justiciabilidad directa para las empresas que coordinan las cadenas en los casos de vulneraciones de derechos humanos y daños medioambientales. En las iniciativas legislativas más recientes, relativas a la gobernanza empresarial sostenible, se hace hincapié en la necesidad de identificar y responsabilizar a la empresa que tiene preeminencia en la cadena y que puede ejercer algún tipo de influencia sobre las restantes organizaciones. Esta empresa es la que debería diseñar la estrategia empresarial y debería redefinir los que considera ser, su misión, su visión y sus valores de gestión en términos de derechos humanos, como parte de su proceso de gestión en sostenibilidad. En este trabajo analizamos estas iniciativas centrando nuestra atención en la directiva sobre diligencia debida en sostenibilidad corporativa, sus oportunidades y sus desafíos.
In the relationships between multinational companies and their value chains, many factors, legal and practical, remain that prevent the determination of direct justiciability for the companies that coordinate the chains in cases of human rights violations and environmental damage. Recent legislative initiatives on sustainable corporate governance emphasizethe need to identify and hold accountable the company that is pre-eminent in the chain and can exert some influence over other organizations. It is this company that should design the business strategy and should redefine what it sees itself to be, its mission, vision and management values in terms of human rights, as part of its sustainability management process. In this paper we analyse these initiativesby focusing on the corporate sustainability due diligence directive, its opportunities and challenges.
