La evolución competencial de los tribunales populares de la II República

Abstract

El presente artículo trata de analizar la evolución competencial que sufrieron los Tribunales Especiales creados por la II República tras el estallido de la guerra civil española. El golpe de estado supuso el desmoronamiento de la estructura estatal y esto desembocó en la creación de una nueva administración de justicia. Ésta buscaba aunar los deseos de las masas populares, que con su empeño habían contenido el triunfo del golpe de estado, y un cierto nivel de institucionalización y sujeción a leyes, que se hacía fundamental para dotar de estabilidad y seguridad jurídica a la nueva estructura judicial.

The aim of this article is to analyze the competence evolution of the Jury Courts created by the Spanish II Republic after the breakout of the Spanish Civil War. The coup d'etat meant the collapse of the state structure, hich lead to the creation of a new kind of judicial system. It seeked to join the people wishes and a certain level of institucionalization in order to bring stability and legal certainty to the new judicial structure.
