Abstract
Em anos recentes tem-se assistido a várias tentativas d recuperação da memória histórica LGBTI um pouco por todo o mundo. Nem sempre foi assim e, durante vários séculos, a homossexualidade esteve invisibilizada, controlada e punida pela religião, pela política e pela própria ciência. Dadas as relações históricas entre Portugal e o Brasil, este artigo pretende traçar a história da criminalização da homossexualidade nos dois países. Refere-se sucintamente a legislação do período moderno (séc. XVI até finais do séc. XVIII), quando o Brasil ainda era uma colónia portuguesa e o que se criminalizava eram os atos pecaminosos e, depois, analisa-se a legislação utilizada contra a figura do “homossexual” nos séculos XIX e XX.
In recent years, there have been several attempts to recover LGBTI historical memory all over the world. This was not always the case and, for several centuries, homosexuality was invisible, controlled, and punished by religion, politics, and science itself. Given the historical relations between Portugal and Brazil, this article aims to trace the history of the criminalization of homosexuality in both countries. It briefly refers to the legislation of the modern period (16th century to the end of the 18th century), when Brazil was still a Portuguese colony and what was criminalized were sinful acts. Then the article analyzes the legislation used against the “homosexual” figure in the 19th and 20th centuries.
