Abstract
La existencia de diferentes órdenes jurisdiccionales sobre la base de la
especialización funcional de los órganos que los integran, en atención a la clase de
pretensiones sometidas a su conocimiento y decisión, así como a la normativa
aplicable para la resolución de las controversias que están llamados a conocer,
genera dificultades en cuanto a la distribución o reparto de los ámbitos materiales
en los que aquellos pueden operar, siendo particularmente llamativas las que
tradicionalmente vienen planteándose en la delimitación de los órdenes social y
contencioso-administrativo. Mientras que el diseño del segundo se hace descansar
en los conflictos surgidos a causa de la actuación de la Administración pública, los
límites del primero se fijan atendiendo a la materia laboral sobre la que versa el
conflicto, con independencia del sujeto o sujetos que lleven a cabo la actuación controvertida, doble criterio que, al no ser absolutamente excluyente, da cobertura
a zonas comunes.
The different jurisdictional orders based on the functional expertise of the courts that compose them, according to the type of claims subject to their knowledge and decision, as well as the applicable regulations for the resolution of the disputes that they are called upon to resolve, generates difficulties regarding the distribution or distribution of the material areas in which they can operate, being particularly striking those that have traditionally emerged in the delimitation of the social and administrative jurisdictional orders. While the design of the latter is based on conflicts caused by the actions of the public administration, the limits of the first are set according to a labor matter on which the conflict is based, independently of the subject or subjects that carry out the disputed action, a double approach that, not being absolutely exclusive, gives coverage to common areas.
