Eficiencia energética y fiscalidad: un enfoque desde la protección del medio ambiente en España

Abstract

El presente trabajo aborda el papel de la eficiencia energética y la fiscalidad como instrumentos esenciales para la protección medioambiental en España, tomando como punto de partida el mandato constitucional de proteger el medio ambiente y la creciente importancia de la fiscalidad extrafiscal. Se realiza un recorrido por la evolución normativa europea, desde la primera directiva de eficiencia energética hasta la más reciente Directiva (UE) 2023/1791, que introduce el principio de “Primero, la Eficiencia Energética” y exige su integración prioritaria en las políticas públicas antes de octubre de 2025. El estudio expone cómo la fiscalidad puede incentivar conductas sostenibles y analiza todas las medidas existentes en España especialmente las deducciones estatales y autonómicas en el IRPF para la rehabilitación energética de viviendas, así como la dispersión y carácter limitado de las bonificaciones municipales (IBI, ICIO, IVTM) y otras posibles medidas. Propone además posibles mejoras en las establecidas o nuevos mecanismos de fomento de la Eficiencia Energética. El trabajo concluye abogando por una revisión profunda de la fiscalidad medioambiental de ámbito estatal, que permita estructurar incentivos eficaces, ampliar su cobertura y asegurar justicia social en la transición energética, subrayando la necesidad de su diseño con vocación universal y finalista para alcanzar los compromisos climáticos y sociales.

This paper addresses the role of energy efficiency and taxation as essential instruments for environmental protection in Spain, starting from the constitutional mandate to protect the environment and the growing importance of green taxation. It provides an overview of the European regulatory evolution, from the first energy efficiency directive to the most recent Directive (EU) 2023/1791, which introduces the principle of "Energy Efficiency First" and requires its prioritization in public policies before October 2025. The study explains how taxation can incentivize sustainable behaviors and analyzes all the existing measures in Spain, especially the state and regional deductions in the Personal Income Tax (IRPF) for energy rehabilitation of homes, as well asthe dispersion and limited nature of municipal bonuses (IBI, ICIO, IVTM) and other possible measures. It also proposes potential improvements to the established measures or new mechanisms to promote Energy Efficiency. The paper concludes by advocating fora thorough review of the national environmental taxation system, which would allow for the structuring of effective incentives, expand its coverage, and ensure social justice in the energy transition, emphasizing the need for its design to be universal and goal-oriented to meet climate and social commitments.
