La Teoría del Estado Totalitario y el "Principio de integración de poderes" en la filosofía jurídica y política de Carl Schmitt

Abstract

Los principales fundamentos intelectuales del Derecho y del Estado desde el punto de vista de la filosofía jurídica nacionalsocialista, elaborados por el conocido jurista alemán Carl Schmitt. El presente trabajo aborda, entre otros, algunos escritos de Schmitt que fueron redactados durante su etapa de filiación al partido nazi. Se analizará la formulación de la teoría del estado totalitario schmittiano o el "Führerstaat" partiendo de su conocida dialéctica amigo-enemigo, y la aplicación de dicha teoría totalitaria como justificación de los crímenes cometidos durante la noche de los cuchillos largos. El papel y relevancia de la figura del mundo académico en la fundamentación y legitimación de la represión estatal realizada por el régimen nazi.

The main intellectual foundations of the law and the State made from the point of the National Socialist legal philosophy, made by the famous german jurist Carl Schmitt. This work addresses, among others, some of Schmitt's writings which were written during his affiliation with the Nazi party. It will be analyzed the formulation of the Schmittianian totalitarian state theory or the "Führer State" based on its well-known friend-enemy dialectic, and the application of this totalitarian theory as a justification for the crimes committed during the night of the long knives. The role and relevance of the academic world in the foundation and legitimacy of State repression carried out by the Nazi regime.
