Aspectos procesales relevantes en la aparición del trastorno mental durante la ejecución de pena privativa de libertad

Abstract

El artículo analiza el tratamiento procesal en el proceso penal español de la enajenación mental sobrevenida cuando ya se ha dictado sentencia y se alega cuando se va a proceder a ejecutar dicha sentencia. Todo ello a partir de dos supuestos: preexistencia de enajenación metal o enajenación mental sobrevenida.

This article analyses the procedural treatment, within Spanish criminal proceedings, of supervening mental incapacity when a judgment has already been rendered and such incapacity is alleged at the stage of enforcement of the judgment. The analysis is based on two scenarios: the pre-existence of mental incapacity and the supervening onset of mental incapacity.
