dc.descriptionA key distinction between the Spanish jury system and its Anglo-American counterpart lies in the obligation imposed on jurors to provide reasons for their verdict. This reasoning is factual in nature, requiring jurors to link each fact they find proven to specific items of evidence presented at trial. This study examines the scope of this obligation, established by the Spanish Constitution as a procedural safeguard of the right to effective judicial protection, and analyses how it was implemented in judicial practice during the first decade following the entry into force of the Organic Act on the Jury Court.
dc.description.abstractLa gran diferencia entre el modelo de Tribunal del Jurado español y el anglosajón es la obligación que tienen los ciudadanos que forman parte del Jurado de motivar su veredicto. Es una motivación de carácter fáctico, donde tendrán que relacionar cada hecho que declaren probado con un medio de prueba concreto de los que han sido practicados en el juicio. El trabajo de investigación analiza el alcance de esta obligación impuesta por la Constitución Española como garantía procesal para el derecho a la tutela judicial efectiva, y cómo se estaba desarrollando en la práctica de los tribunales durante los primeros diez años de vigencia de la Ley Orgánica del Tribunal del Jurado.
