La relación del becario frente a la nueva regulación del contrato formativo. Zonas de concurrencia y elementos de distinción

Abstract

Los debates en torno al empleo juvenil han adquirido en España una importancia creciente en los últimos años. Aquellos que terminan sus estudios y preparan su entrada en el mercado laboral se enfrentan a una carencia de formación práctica y experiencia en los entornos de trabajo. A este tenor, existen diversas figuras contractuales o relaciones jurídicas que se ajustan a lo que el nuevo profesional requiere y le facilitan y aceleran su inmersión en el mundo laboral, entre las que encontramos la figura del becario o los contratos formativos. Que, si bien pueden tener notas comunes, tienen naturalezas distintas: uno se considera una relación laboral propiamente dicha, y otro no. A través de un recorrido normativo en el panorama español y europeo, el cuerpo de este artículo establece el marco regulador de las mencionadas figuras, aludiendo al origen del problema (discernir en la práctica la frontera que existe entre la relación de beca y el contrato de trabajo), contribuyendo al debate sobre la relación jurídica especial de los becarios, su diferenciación con los contratos formativos y un acercamiento a la doctrina y a la jurisprudencia, a través del análisis de las figuras del becario, falso becario, contratos formativos y las bases que determinan la naturaleza del vínculo. Se anotan, como colofón, algunas posibles soluciones; y lo más importante para la determinación de la existencia o no de beca: la realidad fáctica.

The debates around youth employment have acquired a growing importance in Spain in recent years. Those who complete their studies and prepare to enter the labor market face a lack of practical training and experience in work environments.In this sense, there are various contractual figures or legal relationships that adjust to what the new professional requires and facilitate and accelerate their immersion in the world of work, among which we find the figure of the intern or training contracts. That, although they may have common notes, they have different natures:one is considered a proper employment relationship, and another is not.Through a regulatory journey in the Spanish and European panorama, the body of this article establishes the regulatory framework of the aforementioned figures, alluding to the origin of the problem (discerning in practice the border that exists between the scholarship relationship and the contract of work), contributing to the debate on the special legal relationship of scholarship holders, their differentiation with training contracts and an approach to doctrine and jurisprudence, through the analysis of the figures of the scholarship holder, false scholarship holder, training contracts and the bases that determine the nature of the bond. As a climax, some possible solutions are noted; and the most important thing for determining the existence or not of a scholarship: the factual reality.
