La vulneración de derechos de la personas mayores durante la pandemia

Abstract

Durante las semanas más críticas de la emergencia sanitaria provocada por la pandemia de COVID-19, y especialmente en las residencias de mayores, se recomendó relegar a las personas de edad avanzada a la hora de ser derivadas a hospitales y ucis. Estas recomendaciones y su aplicación efectiva en muchos casos bien pudieron constituir una vulneración del principio de igualdad (art. 14 CE), el derecho a la salud (art. 43 CE) y el derecho a la vida (art. 15 CE) de las personas mayores afectadas. En las residencias se padeció asimismo un aislamiento particularmente rígido y duro, que además de poder lesivo del derecho a la libertad (art. 19 CE), tuvo consecuencias tan dolorosas como la muerte en soledad de muchas personas. La pandemia también ha incrementado el edadismo y la consiguiente estigmatización de los mayores, pues durante este tiempo se ha enfatizado, de forma injustificada y exagerada muchas veces, la asociación entre edad avanzada, covid y vulnerabilidad.

During the most critical weeks of the health emergency caused by the COVID-19 pandemic, and especially in nursing homes, it was recommended that the elderly be relegated to hospitals and intensive care units. These recommendations and their effective application in many cases could have resulted in the violation of the principle of equality (art. 14 CE), as well as the right to health (art. 43 CE) and, in connection with this, the right to life (art. 15 CE) of the affected elderly people. In nursing homes, particularly rigid and harsh isolation was also suffered, which, in addition to being detrimental to the right to freedom of movement (art. 19 CE), had such painful consequences as the death of many people in solitude. The pandemic has also increased ageism and the consequent stigmatization of the elderly, since during this time the association between old age, covid and vulnerability has been emphasized, often unjustifiably and exaggeratedly.
