«Ha dicho e publicado que me ha de matar»: Violencia contra la mujer y divorcio en la Sevilla del siglo XVI

Abstract

En el Archivo Histórico Provincial de Sevilla, sección de Protocolos Notariales, muchas veces encontramos auténticas joyas, documentos muy significativos que han dado como resultado importantísimos trabajos de investigación histórica, antropológica y cultural. En este caso hemos hallado varios documentos del siglo XVI donde las otorgantes eran mujeres que sufrían maltrato por parte de sus maridos e iniciaban trámites para poder divorciarse canónicamente, por la Iglesia, o, en algunos casos, retiraban las denuncias iniciadas por violencia que hoy tipificamos de género o machista. Por tanto, tras la transcripción y análisis de dichos documentos, intentaremos arrojar luz a las circunstancias de estas mujeres sevillanas y con qué mecanismos legales contaban para poder poner en conocimiento de las autoridades de la época su testimonio como mujeres maltratadas, interponer denuncias, o retirarlas posteriormente por diferentes motivos, además de iniciar los trámites de divorcio canónico a través de procuradores y notarios apostólicos.

In the Provincial Historical Archive of Seville, Notarial Protocols section, we often find authentic jewels, very important documents that have resulted in very important historical, anthropological, and cultural research. In this case, we have found several documents from the 16th century where the grantors were women who suffered mistreatment by their husbands and initiated proceedings to be able to get a canonized divorce, by the Church, or, in some cases, they withdrew the complaints initiated by violence that we now classify gender or sexism. Therefore, after the transcription and analysis of these documents, we will try to shed light on the circumstances of these Sevillian women and what legal mechanisms they had to bring their testimony as battered women to the attention of the authorities of the time, file complaints, or withdraw them. subsequently for different reasons, in addition to initiating canonical divorce proceedings through procurators and apostolic notaries.
