El Tribunal Constitucional español y la protección indirecta de los derechos sociales

Abstract

En el marco del debate sobre la estructura y la justiciabilidad de los derechos sociales, algunos tribunales internos e internacionales, cuyos textos de referencia no reconocían derechos sociales, han desarrollado jurisprudencias creativas, que les han permitido proteger estos derechos de una forma indirecta. La Constituciónespañola reconoce un notable elenco de derechos sociales. Sin embargo, la mayoría de estos derechos se ven desprovistos de la protección que ofrece el recurso de amparo, la vía procesal específicamente pensada para que el Tribunal constitucional proteja los derechos fundamentales en caso de violaciones individuales. A falta de un mecanismo de garantía que permita la protección directa de los derechos sociales constitucionalmente reconocidos ante el Tribunal constitucional, el objetivo del trabajo que se presenta es valorar la utilización que ha hecho este tribunal de los mecanismos indirectos de protección de los derechos sociales que han empleado otros tribunales.-----------------------------------------------------------------------------------------------------------------In the context of the debate on the justiciability of social rights, some national and international courts have developed a creative case law enabling them to protect these rights even when the national constitution or the international treaty they interpretate did not expressly recognize any social right. The Spanish Constitution recognizes a remarkable cast of social rights. However, most of these rights are deprived of the protectiongranted by the recurso de amparo, the procedural safeguard specifically designed to protect fundamental rights in case of individual violations before the Constitutional Court. In the absence of a procedural safeguard that ensures the direct protection of those social rights before the Spanish Constitutional Court, the aim of this paper is to analyse the Court¿s case law in order to determine to what extent it has made use of the indirect strategies to ensure the justiciability of social rights that other courts have used.
