Abstract
El debate doctrinal sobre la naturaleza jurídica del proceso de ejecución penal ha sido muy intenso en nuestra doctrina, sobre todo en lo referente a la ejecución de la pena de prisión. Este trabajo pretende sostener la naturaleza jurisdiccional de la ejecución con base en lo establecido en la propia Constitución Española de 1978. Para ello vamos a examinar las características de la función jurisdiccional ―el ejercicio rogado de la ejecución penal, su actuación de modo irrevocable y la existencia de desinterés objetivo en sus resoluciones―, las cuales son plenamente aplicables a las decisiones que adopta el órgano jurisdiccional competente para la ejecución penal.
The doctrinal debate on the legal nature of the criminal enforcement process has been very intense in our doctrine, especially with regard to the enforcement of prison sentences. This paper aims to uphold the jurisdictional nature of enforcement based on the provisions of the Spanish Constitution of 1978. To do so, we will examine the characteristics of the jurisdictional function - the exercise of criminal enforcement, its irrevocable nature and the existence of objective disinterest in its decisions - which are fully applicable to the decisions adopted by the court competent for criminal enforcement.
