Abstract
El paisaje cultural o el patrimonio cultural a través del territorio. La Ley de Patrimonio Histórico de Andalucía (Ley 14/2007) representa un verdadero paso en la protección del patrimonio porque introduce una nueva figura de protección del patrimonio a nivel territorial: la zona patrimonial. La Convención Europea del Paisaje (Florencia, 2000) y las leyes españolas precedentes constituyen los factores decisivos para crear esta nueva figura que la ley define como: aquellos territorios o espacios que constituyen un conjunto patrimonial, diverso y complementario, integrado por bienes representativos de la evolución humana, que poseen un valor de uso y disfrute para la colectividad y, en su caso, valores paisajísticos y medioambientales. El territorio es en este caso la principal innovación de la Ley pero también su principal debilidad, que necesita de un trabajo ulterior para precisarlo.
The cultural landscape or cultural heritage through the territory. The law of historical heritage of Andalusia (Ley de Patrimonio Histórico de Andalucía) (Ley 14/2007) represents a real step in the protection of heritage because it introduces a new figure in order to protect the heritage at a territorial level: the heritage area (zona patrimonial). The European Landscape Convention (Florence, 2000) and the Spanish precedent laws have been the deciding factors in order to create this new figure, which the law defines as: those territories or spaces that form a heritage complex, diverse and complementary, integrated by diachronic assets that represent the human evolution. These possess a value of use and joy to the community and, in their case, landscape and environmental values. In this case, the territory is the most relevant innovation of the law, but it is also its main weakness, due to the fact that it needs a further work to precise it.
